As part of a regular policy cycle, the Birds and Habitats Directives are currently undergoing a Fitness Check through the EU’s Regulatory Fitness and Performance Programme. The aim of this evidence-based evaluation is to check whether such legislation is “fit for purpose”.

Adopted in 1979, the Birds Directive represents the first EU nature law – an important commitment for the protection of wild birds that occur naturally within its borders. The Habitats Directive, on its turn, came into force in 1992, proposing to safeguard natural habitats that contain animal and plant species of high conservation value. Nowadays, it protects more than 1000 species and more than 200 habitat types across Member States. Together, the two Directives form the backbone of EU legislation for nature conservation.

The results of the Fitness Check – the future of the Birds and Habitats Directives, literally – will be known in the last quarter of 2016, and will be drawn upon the directives’ performance according to the following criteria:

  • Effectiveness: have the objectives been achieved?
  • Efficiency: were the costs appropriate?
  • Coherence: are the Directives in line with other legislation?
  • Relevance: are the problems presently faced by species and habitats being addressed?
  • EU-added value: did EU action provide an added value compared to what could have been done at national or regional level?

The main inputs to the Fitness Check, to be analysed in light of the criteria mentioned above, consist of reviews of relevant scientific literature and reports, including The Mid-term Review of the EU Biodiversity Strategy to 2020 (October 2015) and the State of Nature in the EU report (May 2015). Consideration will also be given to the opinions requested from 47 EU-level organisations and representative bodies, and 112 stakeholders (the latter represented by pertinent sectors and groups from all Member States), as well as an online public consultation. This public consultation, which lasted for 12 weeks between April and July 2015, had an unprecedented number of participants (from all EU countries and also elsewhere). In total, more than half a million respondents expressed their views on the Birds and Habitats Directives through the 14 multiple choice questions that made up Part I of the questionnaire. Among other things, the vast majority believes that the “Directives are important or very important to nature conservation (98%)”, the “Directives bring additional social benefits (95%)”, and “There is still a need for EU legislation to protect species and habitats (98%)”. As for the 4% of respondents that went on to complete Part II of the questionnaire (which was optional and more detailed), it is worth noting that “The administrative costs associated with the implementation of the Directives are major (60%)”, “There is insufficient funding for implementing the Directives (77%)”, and “The following elements are significantly limiting progress: insufficient stakeholder involvement (65%), ineffective local coordination (62%), gaps in scientific knowledge of species and habitats (61%), unclear wording of the Directives (54%), ineffective EU-level coordination (54%)”.

Like the participation in the public consultation, the environmental crisis faced by humanity is also unprecedented. The need for large-scale, well-structured conservation measures is clear, and the support for them among ordinary citizens is overwhelming. Should there be any changes to the structure and associated actions of the Birds and Habitats Directives, let us hope they strengthen (rather than weaken) the principles that brought about these directives in the first place. Apart from the perspectives of various interest groups and organisations, we should consider with great care what kind of environment we want to leave to future generations.

Kuntotarkastus: Euroopan unionin lintu- ja elinympäristödirektiivien tulevaisuus

Lintujen ja elinympäristöjen direktiivit ovat parhaillaan käymässä läpi uudelleen arviointia osana säännöllistä poliittista sykliä. EU:n sääntelykomitean tavoitteena on arvioida lainsäädännön toimivuutta havaintojen pohjalta.

Lintudirektiivi on EU:n ensimmäinen luontoon liittyvä laki. Se säädettiin vuonna 1979 ja oli tärkeä sitoumus villien EU:n alueella esiintyvien lintulajien suojelemiseksi. Habitaatti- eli elinympäristölaki astui voimaan vuonna 1992. Sen tarkoitus on turvata luonnon elinympäristöt, joissa elävät eläin ja kasvilajit ovat uhattuja. Nykyään se kattaa yli 1000 lajia ja runsaat 200 habitaattityyppiä EU:n jäsenvaltioiden alueella. Yhdessä nämä direktiivit muodostavat EU:n luonnonsuojelulainsäädännön kulmakiven.

Uudelleenarvioinnin tulokset julkaistaan vuoden 2016 viimeisellä vuosineljänneksellä.  Lintu ja habitaattidirektiiviä sekä niiden toimintaa arvioidaan seuraavin kriteerein:

  • Vaikuttavuus: onko tavoitteet saavutettu?
  • Tehokkuus: olivatko kulut kohtuulliset?
  • Johdonmukaisuus: onko direktiivit linjassa muiden lainsäädäntöjen kanssa?
  • Relevanssi: koskeeko ongelmat säädöksissä nimettyjä lajeja ja habitaatteja nykyään?
  • EU-lisäarvo: Toivatko säädökset lisäarvoa verrattuna siihen mitä olisi voitu saavuttaa kansallisella tai alueellisella tasolla?

Lainsäädännön toimivuuden arvioinnin lähtökohtana olevien kriteerien toteutumista arvioidaan tieteellisten tutkimusraporttien ja julkaisujen perusteella. Lisäksi arvioinnissa huomioitiin mm. EU-tason organisaatioiden sekä julkisen verkkokyselyn tuottamat vastaukset. Keväällä 2015 toteutettu 12 viikkoinen julkinen verkkokysely tuotti ennätykselliset puoli miljoonaa vastausta EU-maista ja myös niiden ulkopuolelta. Kysely koostui kahdesta osasta. Ensimmäisessä osassa vastaajat ilmaisivat näkemyksensä direktiiveistä neljäntoista monivalintakysymyksen avulla. 98 % vastaajista katsoo, että “direktiivit ovat tärkeitä tai erittäin tärkeitä luonnon suojelemiseksi” ja “EU lainsäädännöille on yhä tarvetta lajien ja habitaattien suojelemiseksi. Vain 4% vastaajista täytti kyselyn toisen, yksityiskohtaisemman osan. Näissä vastauksissa huomionarvoista oli, että 77% vastaajista oli sitä mieltä, että rahoitus on riittämätöntä direktiivien toteuttamiseksi. Suuri osa vastaajista katsoi, että ”lainsäädännön toteuttamisen hallinnolliset kulut ovat suuret (60%)”, lisäksi nähtiin, että edistystä haittaa “päättäjien huono sitoutuminen (65%)”, “tehoton paikallinen koordinaatio (62%)”, “puutteet lajien ja habitaattien tieteellisessä tuntemuksessa (61%)”, “direktiivin epäselvä muotoilu (54%)” sekä “tehoton koordinaatio EU-tasolla (54%)”.

Tarve hyvin organisoiduille ja laajamittaisille suojelutoimille on selvä. Tavallisten ihmisten tuki ympäristön suojelulle on laajuudessaan vähintään yhtä suurta kuin aktiivisuus kyselyyn osallistumisessa. Jos muutoksia lintu ja habitaattikriteereihin tulee, toivotaan, että kansalaisten suuri kiinnostus ja huoli vahvistaa niitä periaatteita, jotka aikanaan johtivat direktiivin säätämiseen. Huolimatta erilaisten ryhmien ja organisaatioiden intresseistä, meidän tulee pohtia, millaisen ympäristön haluamme jättää tuleville sukupolville.
